This Privacy Policy applies to purchases and browsing activity on lavieenrosejewels.com (the “Site”).
1. Introduction
La Vie en Rose Jewelry LLC, a Texas limited liability company (“La Vie en Rose Jewelry,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains what personal information we collect through the Site, how we use and share it, the choices you have, and the rights available to you, including certain rights recognized under U.S. state privacy laws. This Policy is incorporated by reference into our Terms and Conditions.
2. Personal Information We Collect
We collect the following categories of personal information:
- Identifiers: name, email address, phone number, shipping and billing address.
- Commercial information: products viewed, added to cart, or purchased; order history; discount codes used.
- Payment information: processed directly by our third-party payment processors (e.g., Shop Pay, PayPal, Stripe, or other processors made available at checkout). We do not store your full payment card number on our own servers.
- Device and online activity information: IP address, browser type, device identifiers, pages viewed, referring URLs, and interactions with the Site, collected automatically through cookies, pixels, and similar tracking technologies.
- Account information: if you create an account, your login credentials and saved preferences.
- Communications: information you provide when you contact customer service, submit a product review, or sign up for marketing emails or SMS.
We do not knowingly collect sensitive personal information (such as precise geolocation, government identification numbers, health information, or information about race, religion, or sexual orientation) except where you voluntarily provide it, and we do not use cookies or pixels to knowingly collect such categories from visitors.
3. How We Use Your Information
We use personal information to: process and fulfill orders and payments; provide customer service and respond to warranty, repair, or return requests; communicate with you about your order, including shipping and delivery updates; send marketing communications where you have opted in, and allow you to opt out at any time; personalize and improve the Site and our product offerings; detect and prevent fraud; and comply with legal obligations.
4. Cookies, Pixels, and Advertising Technologies
We use cookies and similar technologies, including advertising pixels from platforms such as Meta (Facebook/Instagram), Google, and TikTok, to operate the Site, remember your preferences, analyze traffic, and deliver advertising that may be more relevant to your interests, including on other websites and apps (“interest-based” or “targeted” advertising).
Sharing information with these advertising partners for interest-based advertising purposes may be considered a “sale,” “sharing,” or “targeted advertising” of personal information under certain state privacy laws, even though we do not sell information for money. Section 8 below explains your rights and choices regarding this activity.
5. How We Share Your Information
We share personal information with:
- Service providers who perform functions on our behalf, such as our e-commerce platform (Shopify), payment processors, shipping carriers, email/SMS marketing platforms, and customer service tools, under contracts that restrict their use of your information to providing services to us.
- Advertising and analytics partners (such as Meta, Google, and TikTok), as described in Section 4.
- Professional advisors and successors, such as legal, accounting, or financial advisors, or in connection with a merger, financing, or sale of business assets.
- Law enforcement or regulators, where required to comply with a legal obligation, protect our rights, or ensure the safety of our customers or the public.
We do not sell personal information for money, and we do not knowingly sell or share the personal information of individuals we know to be under 18 years of age.
6. Children’s Privacy
The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information.
7. Data Retention and Security
We retain personal information for as long as needed to fulfill the purposes described in this Policy, including to service warranty claims (up to the applicable Warranty Period), comply with tax and accounting recordkeeping obligations, and resolve disputes. We use reasonable administrative, technical, and physical safeguards designed to protect personal information; however, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Privacy Rights and Choices
Depending on your state of residence, you may have rights with respect to your personal information, which may include the right to: confirm whether we process your personal information; access a copy of it; correct inaccuracies; request deletion; obtain a portable copy; and opt out of the “sale” or “sharing” of your personal information, or its use for “targeted advertising.”
8.1 Nevada Residents
Nevada law gives residents the right to opt out of the sale of certain covered information for monetary consideration. We do not currently sell personal information for monetary consideration. If this changes, or if you would like to submit a request under Nevada law regardless, you may do so using the contact information in Section 11.
8.2 Texas Residents
The Texas Data Privacy and Security Act (TDPSA) applies to businesses processing Texas residents’ personal data, without a revenue or consumer-volume threshold, except that many of its obligations do not apply to businesses that qualify as a “small business” under U.S. Small Business Administration size standards. Regardless of small business status, Texas law requires that we obtain your consent before selling sensitive personal data (such as precise geolocation, health, citizenship or immigration status, or information about a child under 13). We do not sell sensitive personal data, and if this were to change, we would first obtain your consent.
8.3 California, Colorado, Connecticut, Virginia, Utah, Oregon, and Other Comprehensive Privacy Law States
Several other states have enacted comprehensive consumer privacy laws that grant rights similar to those described above once a business meets that state’s applicability thresholds (typically based on the number of that state’s residents whose data is processed annually, and/or a percentage of revenue derived from the sale of personal data). As an early-stage business, we may not yet meet these thresholds in every state. As a matter of company policy, however, we choose to honor the opt-out rights described in this Section 8 for all Site visitors, regardless of state of residence or whether a particular law's thresholds are currently met by our business.
8.4 Global Privacy Control (GPC)
If you visit the Site with a Global Privacy Control (GPC) or similar opt-out preference signal enabled in your browser, we will treat this as a valid request to opt out of the sale, sharing, or targeted-advertising use of personal information collected during that browser session, for the specific browser and device used.
8.5 How to Exercise Your Rights
You may exercise the rights described in this Section 8 by:
- Emailing us at support@lavieenrosejewels.com with “Privacy Request” or “Opt-Out Request” in the subject line; or
- Enabling a recognized browser-based opt-out signal, such as the Global Privacy Control.
We will process verified requests in accordance with applicable law. A request submitted through a browser signal will apply to the specific browser and device used to submit it, unless you indicate otherwise. We will not discriminate against you for exercising your privacy rights, such as by denying goods or services, charging different prices, or providing a different level of quality.
8.6 Verification and Authorized Agents
To protect your information, we may need to verify your identity before fulfilling certain requests, such as by confirming information associated with a recent order. The information we request will vary depending on the nature and sensitivity of your request.
If you choose to designate an authorized agent to submit a request on your behalf, we will require written authorization from you and may still need to verify your identity directly before processing the agent’s request. Authorized agents must provide documentation demonstrating that they are lawfully permitted to act on your behalf under applicable state privacy law.
9. International Data Transfers
At this time, we sell and ship exclusively within the United States, and our systems and service providers are based in the United States. If we begin shipping to Mexico or another country, we will update this Policy to describe any relevant cross-border data handling.
10. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. The “Effective Date” at the top of this page reflects the most recent revision. Material changes will be posted on this page.
